The Dream Act Vs Deferred Action for Childhood Arrivals

It's important not to confuse the two programs because they are not one of the same. The Dream Act, otherwise known as "Development, Relief, and Education for Alien Minors," is a legislative proposal, if enacted, would have afforded conditional permanent residency to certain undocumented immigrants. This law would have required that eligible applicants are of good moral character, graduate from an American high school, obtain a GED, are admitted to a community college or a four-year university, join the military, arrive in the United States before age 16, be between the ages of 12 and 35 at the time the bill is enacted, live in the country continuously for at least five years prior to the date of arrival, and if male, register with the Selective Service.

For the first six years, successful applicants would be given "conditional" status to live and work in the United States. They would further be required to satisfy at least one of the following three conditions prior to being permitted to obtain permanent residency: 1. graduate from a two-year community college; 2. complete at least two years towards a four-year degree; 3. serve two years in the U.S. military. Upon successful completion, the applicant would become eligible to apply for permanent resident status to legally reside in the United States. During this conditional period, though the approved applicant would not be eligible to apply for federal grants, he/she would be permitted to apply for student loans and work study. At the end of the conditional period, if the applicant satisfies all of the conditions, in addition to permanent residency, the applicant would eventually be permitted to become a U.S. citizen.

Because Congress has not been able to enact this bill after multiple attempts, on June 15, 2012 the President of the United States signed an executive order known as the "Deferred Action for Childhood Arrivals" (DACA) to provide some of the same benefits to the undocumented immigrants who would have benefited under the Dream Act. The eligibility requirements under DACA are the same as those in the proposed Dream Act. But unlike the dream act proposal, DACA only provides two of the benefits in the Dream Act to eligible applicants: removal of the fear of deportation for two years, and the opportunity to apply for work authorization. It does not, however, confer any legal status on eligible applicants or provide a path to legalization. Moreover, because DACA is an executive order, unlike the Dream Act, the president of the United States can change it at any time without congressional approval.

Ten Commitments for Men by Tom Massey: Book Review

Tom Massey, who is a long time corporate leadership trainer, has produced a truly excellent book on how to navigate through life with commitments to high standards, integrity, enthusiasm, and good health. His ten points offer a road map based on wisdom and experience, his and others. The book is well written and organized, at the same time being an enjoyable read.

As a retired Chief of Police and the author of my own book, Leading beyond Tradition, it was my responsibility to provide the employees and citizens with such a map for their safety and work experience, as well as the quality of life for the community. I have taught leadership extensively in the public and private sectors and recognize there is, at best, inconsistency in what leadership actually is and how to make it work in today's world. Leadership is about people and Mr. Massey clearly recognizes those principles that constitute success.

The ten commitments Mr. Massey lists and describes are really what it takes to not only lead, but live your life to its fullest with honor and dignity. The criticality of each commitment cannot be overemphasized, and by combining all ten the practitioner lives the behaviors and models them to everyone. It has been demonstrated that people who associate with negative people themselves become negative and cynical. One's attitude is a choice, solely that of the individual, and the commitments in Mr. Massey's book are the guide to follow. While they are nothing new, they are what is necessary. Every successful person over the ages has believed in and practiced these commitments.

It has been said that once a person stops learning, they languish in the past, while one who commits to continuous learning and improvement stays current and able to live well and contribute at a higher level. The anecdotes provided in Mr. Massey's book are relevant and aligned with delivering his message. This is a book that should be read by everyone. It should be part of every home library, public library, and educational institution. These are the principles that made us great, made us what we are. We need to know them, understand them, and live by them.

Barbecue Success With The Rule Of Thirds

Ever been to a barbecue party where the 'chef' placed as much food as he could possibly fit onto the barbecue grill, every so often stabbing the food with a fork and juggling it around so that it cooks evenly? Ever noticed how, within a few minutes, the flames start gently flickering under the food, the chef proudly standing back admiring the char grill effect that he's creating? Ever notice the panic that sets in when the flames suddenly leap up and around the food burning it black on the outside and leaving it raw on the inside?

The difference between great char grilled barbecue food and burnt offerings lies in a few small precautions. The chef that we've just described made a few fatal errors that could easily have been avoided. Before discussing the errors though, lets consider the equipment that we're talking about. Although the same can happen with gas as with charcoal, gas grills can be turned lower, or off, when the flames start getting out of control. The flames can also be controlled if the barbecue grill has a tight fitting lid, as with a Weber kettle grill. However most people seem to cook on an open top barbecue grill with the lid, if it has one, open. Note that we're talking about a barbecue grill here, where the food is cooked directly over the hot coals. True barbecue uses indirect heat with the food fully enclosed as though in an oven. So, the barbecue grill that our imaginary chef is using is an open top, charcoal, barbecue grill.

Now lets have a look at our imaginary chef's errors.

First, he filled the grate with charcoal along its entire length, providing a constant heat source, with no area of lower heat to place food if it started to burn. A simple solution is to use the rule of thirds. Imagine the grate of your barbecue being in thirds. Fill two thirds of the grill with charcoal and leave the remaining third empty. Cook your food over the hot coals and when your food is ready, or starts to burn, or creates out of control flames, move it over to the section above the empty grate. The food will stay warm but won't cook any more (or possibly it will but much more slowly), and wont cause any flare-ups. A further refinement can be had, if you've a large enough grill, by placing a double level of coals in one third of the grate, a single level of coals in the middle, and no coals in the final third. You now have three levels of heat!

A further mistake was to overfill the grill. Completely filling it leaves no room to manoeuvre the food. You're not able to turn it for even cooking and you've no space to move the food to a lower heat. Assuming that you're using the rule of thirds as described above, , when you first start cooking, leave empty the area of the grill above where you've placed no coals. You've then space to move the cooked food into. Secondly, don't pack the cooking part of the grill with food. Leave room to comfortably turn your food.

A second problem caused when over filling the grill is to use foods that require different cooking times. When the coals are first ready to use, they're at their hottest. This is the time to cook small, thin items of food that can be cooked in a short time with a high heat. These include items like sausages, burgers, kebabs and small pieces of meat off the bone. Don't forget that food, such as burgers and sausages, drip fat and juices onto the charcoal during cooking and it's this that causes flare-ups. So you'll need to constantly watch the items of food and move them to an area of lower heat if necessary (did I mention the rule of thirds? ). After the heat has died down somewhat, start grilling food that takes a little longer to grill like chops and steaks and meat on the bone. Finally when the heat is even lower, grill food like fruit kebabs that really only need heating through.

Last, but not least, our imaginary chef stabs his food with a barbecue fork to turn it over. During the initially few minutes of grilling, the heat seals the surface of the meat, sealing in the juices. When the meat is stabbed the juices flow out onto the coals, causing the meat to dry out and become tough, and producing a flare up which burns the food. When turning food, always use barbecue tongs.

With a charcoal barbecue controlling the heat is difficult. Instead you need to ensure that you cook your individual items of food at the most appropriate time and that you have separate areas of heat. Use the rule of thirds to provide separate areas of heat. When cooking your food, first grill quick cook food when the coals are at their hottest. Second, cook food that requires cooking at a mid temperature for a longer time. In an age where there is considerable hype about the wonders of modern technology, Bob Seidensticker prods us to take a step back and put everything into a more realistic perspective or as he most aptly states, we should vaccinate ourselves against hype.

Seidensticker's principal theme in FutureHype: The Myths Of Technology Change is that the pace of technological change does not increase exponentially. According to Seidensticker, although we may be living in an era of fast change, this does not imply that we are the only ones to have experienced this phenomenon. In earlier times people had their own examples of fast change and to discover if our times are really unique, it is necessary that today's social change be compared to that of the past. In fact, as Seidensticker warns us, "the popular perception of modern technology is inflated and out of step with reality."

Divided into two parts, the book first illustrates how we fall into the trap of incorrectly and myopically seeing technology. Seidensticker underlines his contentions with several concrete examples that are elaborated upon throughout this first section.

As an example, we are reminded that a technology might be innovative, but the product that we build from that technology does not necessarily have to be revolutionary, particularly if our predictions are off the mark. The Internet may be able to provide us with a great deal of information, however, will this lead us to being better informed. Probably not, as the downside is that much of the information is unreliable and pure garbage!

Healthy Eating With Salads

It is a commonly known fact that the body needs at least 2 servings of vegetables and 2 servings of fruits on a daily basis. But not everyone likes to eat fruits or vegetables. I have been lucky as I grew up liking to eat vegetables. Of course as a child, I was a little picky, choosing only safe vegetables like cucumber and cabbages. I was also fortunate that my mom would make a delicious sauce when she tried to get us eating raw vegetables. So here I would like to share this family recipe for a salad that has been a long time family recipe. We usually serve this salad with spicy food like curry, but it is just as delicious when eaten with other main dish.

The ingredients are simple and can be easily found at any of your neighborhood supermarkets.

Salad with Peanut Sauce

You will need: Lettuce, cut into 2-inch length 1 medium sized cucumber, sliced 1 medium sized tomato, sliced 2 Hard boiled eggs, sliced 1 cup of roasted peanuts, grounded 4 tablespoon of chili sauce 2 tablespoon of tomato ketchup ½ cup of hot water

Steps: Plate the vegetables and hard boiled eggs in a circular pattern, in this recommended order: Lettuce as the bottom first layer, then the cucumber followed by the sliced tomato and lastly the hard boiled eggs on top. Set aside.

Put the grounded peanuts in a deep bowl. Add the hot water and still well, ensuring that all the clumps are dissolved. Then add in the tomato ketchup and chili sauce. Stir until well combined. If you like more heat in the sauce, add more chili sauce. Drizzle the peanut sauce generously on the salad.

The ingredients in this recipe can be easily substituted and varied to suit your personal preference. For example, use baby cucumbers which are juicer and sweeter. Or add in some sliced boiled potatoes to make this salad a light meal.

To make it more appetizing, try serving the sauce separately as a dip instead.

Electronic Evidence as the Smoking Gun

Electronic communications--particularly email--may contain a treasure trove of evidence in commercial litigation matters. There are three key reasons for this fact. First, email is a very informal means of communication. Why? I don't know, it just is. Though I personally insist on specific grammar and sentence structure in my "hardcopy" written correspondence, court pleadings, etc., in emails I sometimes choose not to follow the rules of written English.

Second, though intellectually many of us know it is not, email "feels" anonymous. I'm sure there have been studies conducted in effort to understand why email feels anonymous. Maybe it's because of the instantaneous nature of email--you can simply vent your emotions and knee-jerk reactions immediately and press the send button, rather than having time to reflect on your written thoughts as you otherwise would if you were forced to sit down and write a letter; sign it with your own hand; put it in an envelope; put a stamp on in it; and take it to the mailbox and mail it. Whatever the reason(s), the fact of the matter is that email does feel anonymous.

The third reason email evidence can contain critical evidence in a commercial litigation case: permanence and retrievability. Most people don't realize that when they "delete" an email from their email program it actually remains on the computer or network unless and until the portions of the computer's memory containing the email are overwritten by other information. You can be certain, however, that every single electronic commuincation you make--email or otherwise--is being recorded somewhere. Perhaps on your company's network server, perhaps at your Internet service provider, or perhaps on your own computer's hard drive. Savvy litigators know this fact and, depending the stakes of the case, you could end up receiving a letter such as this should your business find itself in a business dispute:

Dear Mr. John Doe:

This is a notice and demand that evidence identified below in paragraphs 2 through 5 must be immediately preserved and retained by you until further written notice from the undersigned. This request is essential, as a paper printout of text contained in a computer file does not completely reflect all information contained within the electronic file.

The continued operation of the computer systems identified herein will likely result in the destruction of relevant evidence due to the fact that electronic evidence can be easily altered, deleted or otherwise modified. 4. You must retain and preserve all backup tapes or other storage media, whether on-line or off-line, and refrain from overwriting or deleting information contained thereon, which may contain Electronic Data identified in paragraphs 2 through 4.

In order to alleviate any burden upon you, we are prepared to immediately enlist the services of a computer forensic expert to image and examine all drives and media in your custody and control which may contain Electronic Data relevant to this matter. If you enlist your own computer forensics expert to generate evidentiary images of all electronic evidence identified above, demand is made that such expert utilize industry standard computer forensic software in order to facilitate and enable the processing and exchange of such evidence in this matter.

Should your company receive a letter like this, you should take it extremely seriously. Continuing to use any computers or other devices identified in such a letter will result in data being overwritten, which the courts would interpret as destruction of evidence.
